These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "user") and INCARE CyberSecure ("INCARE CyberSecure," "we," "us," or "our") governing your access to and use of www.incarecyber.com and all related pages and content (collectively, the "Site").

By visiting or using the Site, you represent that you are at least 18 years of age and have the authority to agree to these Terms on behalf of yourself or any organization you represent.

A professional advisory relationship is established only upon execution of a written engagement agreement signed by both parties. Until such an agreement is in place, any information exchanged through this Site — including through the contact form — does not create a client relationship, does not constitute confidential professional communications, and does not obligate INCARE CyberSecure to provide any services.

Information provided on this Site regarding HIPAA, cybersecurity frameworks, and regulatory compliance is general in nature and may not apply to your specific situation. Always consult a qualified professional before making compliance or security decisions for your organization.

4. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, icons, images, written guides, frameworks, and the overall design — is the property of INCARE CyberSecure or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which INCARE CyberSecure is domiciled, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Site shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration body, unless otherwise required by applicable law.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date above. Material changes will be communicated prominently on the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Site.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and INCARE CyberSecure with respect to your use of this Site and supersede any prior agreements or understandings related to the same subject matter.
